These Terms constitute a legally binding agreement between you and SwarmHire ("SwarmHire," "we," "us," or "our"). The Service is provided for personal, non-commercial use by individual job seekers. Use by staffing agencies, recruiters, or automated systems acting on behalf of third parties is prohibited without our written consent.
You agree not to use the Service to:
We reserve the right to investigate and take appropriate action against violations, including suspending or terminating your account and reporting conduct to law enforcement.
You retain all ownership rights in the content you upload or create through the Service, including resumes, cover letters, notes, and profile information ("Your Content").
By uploading or creating Your Content, you grant SwarmHire a worldwide, non-exclusive, royalty-free license to store, process, display, and use Your Content solely to operate and provide the Service to you. This license ends when you delete the relevant content or close your account, subject to reasonable technical lag.
Cover letters and other content generated by SwarmHire's AI features are produced based on inputs you provide. You own the output of AI generation that is specific to your inputs. However, AI models may produce similar outputs for different users. We make no claim of exclusivity on AI-generated text.
All rights in the Service itself — including software, design, trademarks, logos, and branding (including "SwarmHire" and related marks) — belong to SwarmHire. Nothing in these Terms grants you any right to use SwarmHire's intellectual property except as necessary to use the Service as permitted herein.
SwarmHire uses artificial intelligence to generate cover letters, analyze resumes, and provide job recommendations. You acknowledge that:
The Service integrates with or links to third-party services, including job boards, data providers, and AI platforms. These third parties have their own terms and privacy policies, and we are not responsible for their practices or content. Your interactions with third-party services are solely between you and those parties.
Job listings displayed in the Service are sourced from third-party providers. We do not verify the accuracy or availability of job listings, and we are not responsible for the conduct of any employer or recruiter.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SWARMHIRE DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL SWARMHIRE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED $100 USD OR THE AMOUNT YOU PAID TO SWARMHIRE IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless SwarmHire and its owners, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
By you: You may close your account at any time through account settings or by emailing swarmhire@gmail.com. Termination does not relieve you of obligations incurred before the termination date.
By us: We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. We will make reasonable efforts to notify you of termination, except where doing so could cause harm or violate legal requirements.
Upon termination, your right to use the Service ceases immediately. Sections 6 (IP), 7, 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), 13 (Governing Law), and any other provisions that by their nature should survive, will survive termination.
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of laws principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
Informal Resolution: Before filing any legal claim, you agree to contact us at swarmhire@gmail.com and attempt to resolve the dispute informally for at least 30 days.
Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and SwarmHire regarding the Service and supersede all prior agreements.
Severability: If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
